The following due diligence materials are being provided or made available to Tenant for review. Links, notes, file locations, explanations, and supporting information may be added under each item.

1. As-Built Drawings of the Premises.

Landlord Response

Existing shell, structural, architectural, mechanical, electrical, plumbing, and related as-built drawings, if available, will be provided to the extent located in Landlord’s possession.

Landlord Response

Landlord has prepared conceptual North, South, and West elevation renderings for the former Macy’s premises, which generally reflect the existing exterior building colors shown below. Tenant storefront, façade, and signage plans remain subject to Landlord approval and applicable COREA requirements.

3. Landlord Signage Criteria

Landlord’s building and signage criteria documentation.

Landlord Response

Tenant signage shall be subject to Landlord approval and the applicable signage provisions contained in the COREA and any subsequently approved storefront and signage plans.

Landlord Response

Pylon, monument, wayfinding, directory, and other mall signage may be controlled by the mall owner, the COREA, and/or mall signage criteria. The signage page is provided for reference only and does not guarantee Tenant rights to any specific sign, panel, or location. All signage rights remain subject to mall owner approval, Landlord approval, applicable governmental approvals, and the COREA.

7. Title Policy, Survey, and Title Exception Documents

Title policy, survey, and title exception documents, including covenants, easements, liens, encumbrances, and restrictions of record.

Provided materials include recorded documents affecting use of the Premises, access rights, easements, exterior signage rights, and other recorded restrictions affecting the property.

8. Environmental Reports

Most recent Phase I Environmental Site Assessment and Phase II Environmental Site Assessment, if applicable.

Landlord Response

Landlord is providing the most recent Phase I Environmental Site Assessment currently in Landlord’s possession. Landlord did not order a Phase II Environmental Site Assessment relating to the Premises.

9. Geotechnical Report

Geotechnical report relating to the Premises or property.

Landlord Response

Existing site plans reference historical soil borings; however, no standalone geotechnical report is currently in Landlord’s possession. In lieu thereof, Landlord has provided existing floor load / structural capacity information relating to the Premises.

10. Traffic Studies

Traffic studies relating to the Center or applicable property area.

Landlord Response

Historical traffic studies may have been prepared in connection with the original development of the property; however, no formal standalone traffic study is currently in Landlord’s possession. In lieu thereof, Landlord has provided publicly available traffic count information for the surrounding roadway network.

11. Property Condition / Inspection Reports

Property condition and inspection reports relating to the Premises and major building systems.

Landlord Response

Inspection reports and service records will be provided to the extent available in Landlord’s possession. Certain building systems, including HVAC equipment, fire alarm systems, and fire protection systems, are anticipated to be replaced, upgraded, or modified as part of Landlord's Work and/or tenant improvements.

12. Ground or Master Leases

Copies of any ground leases or master leases affecting the property.

The Premises are not subject to any ground lease or master lease.

Existing electric vehicle charging agreements affecting the property.

Landlord Response

The Premises are not subject to any electric vehicle charging agreements.

14. Permits and Notices of Violation

Copies of permits relating to the Premises and any notices of violation within the last five years.

Landlord Response

Landlord has not received any notices of violation affecting the Premises during Landlord’s period of ownership and is not aware of any outstanding notices of violation affecting the Premises. Copies of material permits, if located in Landlord’s possession, may be provided.

15. Litigation Schedule

Schedule of all litigation relating to the Premises or the Center.

Landlord has not received written/oral notice of any pending litigation materially affecting the Premises.

16. Other Information or Documents Requested by Tenant

Any other information or documents requested by Tenant during due diligence.
